I would have thought any compensation would be a fixed amount, not something you had to negotiate.

I think we’ll end up with another what the club thinks is a safe choice ( like they thought with Emery) but reality is it’ll be another uninspiring choice, I have zero faith in this board / ownership.

If you sack someone, you should waive all rights to compensation if someone else gives them a job. Because you know, they’re fucking unemployed, so why should another club pay you fuck all.

Totally different situation, but it puts me in mind of Chelsea firing Mutu cos he tested positive for cocaine. Some time later an Italian club signed him and Chelsea sued him for the transfer fee they didn’t get. I didn’t much like that either, they chose to fire him, they could have treated it as a health issue and tried to help him get better, but it suited them not to. That’s fine, but for me that should have been the end of matters, he should have been allowed to serve his punishment, get his life back on track and still make something of his career.

It would still surprise if they went for someone with little to no 1st team experience, I’m expecting it to be someone with a decade experience or so and fairly well known that’ll help get low IQ fans onside for a while.

I think it’s a matter of Levy enforcing the law. If you lose your job you have a duty to mitigate your loss in English law. So levy has made it clear that if he’s paying off the contract he wants a refund if Poch gets a new job during the notice period.

Actually I agree with this 100 percent. Don’t like paying off notice periods when the employee doesn’t work it and always use the duty to mitigate argument as best I can. Any HR director worth their salt does the same these days. Think Levy is perfectly entitled to reduce his loss on the pay off and the law agrees with him so why not?

It means we’ll go with someone like Nuno or Howe and majority of fans will believe they can turn us into the team we want to become for like 18 months until they realise.

Well yeah, absolutely entitled to do so if the law says so, no arguments from me.

I’m not familiar with the laws surrounding it, so I guess cos I’ve never heard of this happening before when a manager gets fired and re hired, it sounded abnormal.

I think this is the key part. It’s been presented one way in that tweet where the reality is it will be between levy and poch.

I will say one thing about Arsenal now, I’m so immune to disappointment and failure with them that bad results don’t ruin my day in the slightest anymore.

As for the next manager I’m expecting someone average to no good, so I’m not going to lose any sleep over it when it happens.

Question boils down to details…

My guess is that under the departure, he was “paid off,” part of that “pay off” was allocated to “wages” through the EOY.

What this COULD mean is that effectively instead of paying Poch, we are paying Spurs for his WAGES, which makes sense and is perfectly fine.

The larger question is if there are other types of clauses in the exit agreement that are not precisely stipulated (ie AFC or ManU have to negotiate something with Spurs)… this seems unlikely unless Poch’s attorney is an idiot or Poch has zero desire to include those in his job search…

And of course there are other terms potentially, but I am not familiar with employment law in that part of the world, so who knows what is kosher to do?
