There was an update to the 10 year old abortion story. Apparently the reason they went to Indiana to get the abortion was not because in Ohio they could not. In fact they abortion law makes exception for rape but you would have to report it which is where it gets interesting. The mother went to Indiana to avoid reporting her daughters rape and rapist (in fact she was defending him :grimacing:). They even lied in the report say in was a 17 year old minor when I’m reality it was a 27 year old man. The story is so fucked these parents used they child rape as political football instead of getting justice. There guy has been arrested now and this whole situation is being investigated as the doctor also failed to report the raping of a minor :man_facepalming:t5:

Here are the exceptions from the Ohio code:

Division (A) of this section does not apply to a physician who performs a medical procedure that, in the physician’s reasonable medical judgment, is designed or intended to prevent the death of the pregnant woman or to prevent a serious risk of the substantial and irreversible impairment of a major bodily function of the pregnant woman

That’s it. No mention of rape.

Could a clever lawyer find a way to fit a 10 year old child into one of these categories? Absolutely. But there is no explicit authorization for abortion in a rape under this statute.

First of all, what the Ohio AG released isn’t binding. What they released is an “explainer” which would probably have the same effect as an “Opinion of the Attorney General” (yes the “o” is uppercase, it’s a legal term of art and super obnoxious). An “Opinion” is an AG’s office’s official interpretation of a law or legal issue. Since Courts in the USA don’t perform advisory rulings, government entities or even citizens could seek an “Opinion” from an AG to get clarification on how the main elected attorney in their state would view a specific legal issue. They are not binding for courts but for someone like me, can be used at work to help justify legal positions or precedents.

So what we have is an elected official giving their interpretation of a law that they would be able to enforce. It doesn’t necessarily stop a local prosecutor from bringing charges, although a person charged could certainly cite to the AG’s “Opinion” even if it isn’t binding on courts.

I understand your position that this exception existed in the law but in my professional experience that’s just not how it works. It’s a sloppily drafted law and you can tell It’s poorly written if the AG has to release this explainer claiming there was an exception in the law the whole time when it’s clearly not explicit and relies on that particular AG’s interpretation of the law.

All in all the situation is a shit show I knew there was to the story but what I read I wish I did not. Humanity has no hope left

At the end of the day they are still miles ahead and remain very powerful, but the way they have made themselves look on Ukraine, and with these Middle Eastern nations getting all uppity with them is a bit weak sauce.

The NRA was giving it big on Twitter boasting about how this particular shooter was killed. There is something rotten in the way the USA thinks about guns. I’ll never understand it. Especially the obsession over handguns. We are far far far too overworked and strung out mentally to have millions of people carrying an easily concealed gun around.
