I mean it’s totally fair game. It’s the argument I’d make if I were his attorney. I’m not familiar with how the CPS does their charging decisions but when you’ve got multiple complaints against one guy it’s always a little dicey to try them all at once. The case doesn’t sound like it was all that strong but I guess he didn’t want to take a plea or they never offered him something he’d consider taking.

Yeah, it def paid off. Sounds like the CPS case wasn’t that great. No physical evidence which juries love and texts that don’t match what some people thing is “correct” behavior from a victim.

Idk how political the CPS is but maybe they felt like they had to try the case.

I wonder if this changes the stance of some on Partey. I’ve put that thread on ignore so not sure what stance OA has on it now but the hate he’s getting online and in media is insane. I’ve even seen segments on Talksport and ESPN talk about it with a wink, dude’s been getting booed constantly in away games.

If he gets acquitted based on similarly shaky evidence I’m sure some Arsenal supporters will be more vocal about supporting him. But all those privacy laws you guys have over there means nobody can even read the police reports, right?

But in terms of rival fans? No chance. He’s getting the treatment for the rest of his time in England imo. Rival fans will just use it as “banter”. Didn’t people used to heckle RvP about an alleged assault?

Regarding the Partey case, wasn’t there clear audio and verified texts on Snapchat that was released publicly by the accuser? Or was that another player :thinking:

So say you are representing this woman, who claimed to have been raped by Mendy/Matturie, and then messaged her friends about having the best night. What explanation would you offer? She claimed to have been raped by Matturie in Mendy’s home, then went along with him to his home, and claimed to have been raped again. I am intrigued by how that can be explained by any one, lawyer or not.

And while there’s no handbook, there’s good old common sense. Or does that have no place in a courtroom?

I would imagine the prosecution would argue that it was a form of Stockholm Syndrome.

That might explain going with him to his house, but not the voice message. And even that is a hard sell cause Stockholm Syndrome develops over a period of days and weeks, not hours.

So pretrial you’d interview this witness and present them with the texts. You’d tell them that if this goes to trial that the first thing the defense will do is use those texts. Then you’d get an explanation from the witness as to why they sent those texts. If you feel like you can put on a case then you go forward. The witness would testify on direct and you could try to have them explain the texts knowing they’re going to get clobbered on cross examination for it.

You could also investigate to see if the witness confided in anyone that the assault or rape occurred despite also sending the texts.

I guess you could look for an expert witness to educate the jury on how there’s no set playbook on how a victim behaves but idk that you’d automatically default to calling an expert.

Bottom line is that the texts sound like a huge obstacle for the CPS to explain and there’s really no good way to do it that would satisfy jurors who, at least in my experience, expect all victims to walk straight to a hospital post assault or rape, full of DNA evidence and disclose everything complete with video surveillance. These cases are really hard to try from the prosecution standpoint. In the jurisdiction where I practiced you only ended up in trial if the State’s case was weak.

The man was, as established in a court of law, accused of a crime he didn’t commit. Lost his multimillion pound career and was remanded in custody without good cause. His fellow professionals, who I would imagine view this as their own personal nightmare express solidarity with him now that he has, once again, been established to be not guilty in a court of law and still the outrage brigade think there’s something here for them to throw a fit about.

There really needs to be more pushback against these people.

Keep seeing this “not guilty doesn’t equal innocent” shit. Do they even realize how mad it is to get cleared of all those charges? It’s not like he’s some super celebrity with unlimited access to money that can’t be taken down.

Is it really that hard for people to grasp that some accusations may be false and specifically targeted?
Are people genuinely shocked to hear celebrities or rich people getting exploited and manipulated. This isn’t even an male or female exclusive.

Even if you are found innocent, a lot of people will still believe you are guilty.
